Last minute $10k increase from dealership

Car dealership is Chula Vista Ford in San Diego, CA

I special ordered a Bronco in November, putting down a deposit with the price being MSRP. Order form, and window stickers reflect that price as well. I've been in contact with the dealership for months for updates, and 2 weeks ago they told us it will be delivered soon as it is in state. Today I receive a phone call from the salesman saying they are increasing the price $10k and tried to pressure me to come in and sign paperwork. I spoke with the the General Manager, to which his explanation is that they are receiving so few cars and have so many salesmen that need to feed their families. After going back and forth with this man continuously interrupting me about reselling the car for more or him being able to sell it for $20k or $30k more he said he would call me back. The salesman I was previously working with called me twice, with the last conversation saying he could add on paint protection and some alarm system thing that would be approx. $5k to add on instead of the $10k mark up.

I want to know if my car does come in in the next couple days, can they just up and sell it to someone else while we are going back and forth?
I have my signed purchase order, are they not obligated to honor that?

Special orders should not have an addendum. Addendums or mark ups are for new vehicles you're purchasing that's on the lot already. But if it's a special order they can't just put a $10k on top of the MSRP.

They are not allowed to sell it . If you have your vin number and all the paperwork when you ordered it, they have no choice but to fulfill the deal without mark up.

You can have a paper signed by the sales manager agreeing to MSRP, but they sure as heck can add a hefty ADM, and then keep the Bronco when you refuse to pay it. There are tons of threads here regarding it.

Our dealership honors the MSRP on special orders. We don't put an addendum on those.

This is why I will say it again and have done it myself. After you receive your Full 17 digit Vin number and your bronco is confirmed in transit to your dealer...go ahead and have the F&I manager process your loan!! Payments wont start for 45 days and once the loan approved, the lender owns it...not the dealer. Thus no ADM.

As for OP situation I would say "I have a family to feed too and 10K ADM is our food budget for the entire year+." If no luck, ask who gets the ADM, the dealer or YOUR salesman (not all salesman)? Maybe if they gave you every warranty and accessory available for 10K ADM...Maybe. even then make sure the ADM is financed and not paid out of pocket. You might need a lender that will loan up to 120% "loan to value" to cover the bronco + ADM. Try Altura or Logix if dealer has no other options beyond Ford Motor Credit.

Worst case I would order again maybe from a new local dealer/fresh start, obtain a signed purchase agreement that also specify no ADM will be added, wait, and follow advice above on processing the bronco loan Before it hits dealer lot.

Without a VIN basically all you had is a price agreement for a Bronco. Not your Bronco. Many dealers are pulling this and they are getting away with it. Ford was stepping in early on but now take the stance of ordering from another dealer if you aren't happy with the price.

With the order banks closing this is only going to get worse. In fact many dealers are hoping people walk away. That gives them another stock Bronco to sell for whatever they want.

Our dealership honors the MSRP on special orders. We don't put an addendum on those.

And that's how it should be. I believe like you. Dealer stock, let them jack up the price all they want. But if someone comes in, chooses their trim and options, it's theirs when it comes in, and they shouldn't be scammed out of it, starving salesmen or not.

Did you get a signed buyers order or anything with MSRP pricing after you were issued a VIN?? If not there isn't much you can do.

And I really don't think Ford will do anything. There are too many cases of this for them to step in on every one. But it's worth a shot.

Did you get a signed buyers order or anything with MSRP pricing after you were issued a VIN?? If not there isn't much you can do.

And I really don't think Ford will do anything. There are too many cases of this for them to step in on every one. But it's worth a shot.

That is just an order summary. And nothing indicating MSRP pricing anway.

I have two orders. One dealers gave me a signed buyers order with the MSRP price noted.

The other I have a signed DORA with invoice price circled noting this is my price and signed by the manager.

And I will be totally honest. I am not 100% sure I would get either of those prices. I am only hoping that they honor what they said.

They are not allowed to sell it . If you have your vin number and all the paperwork when you ordered it, they have no choice but to fulfill the deal without mark up.
You get a vin when you order? And paperwork? Which dealer does that?

The vin number is given by Ford. It is emailed to you by Ford.

This same thing happened to me 6 mos ago when I went to pick up my bronco. They had tacked on 20k to the msrp and without a forewarning. Needless to say I was very angry and then tried very nicely to let them know that I was prepared to spread all over bronco nation, social media, ford and the local news. They backed right off but that was in September 21, things have changed and I'm sure dealerships figured out how to legally get around it by now. It's a terrible look for not only the dealerships but for ford. I didn't think that this would have become such a significant problem this far in the game.
And, I would clarify those very important lingering questions you have right away with your dealership!

I would say this might actually be getting better. Customers aren't giving up so easily anymore, raising hell on Twitter, FB, and leaving mass, negative Yelp and Yahoo reviews and miraculously those dealers aren't charging an ADM any longer lol.

There is so much wrong info in this thread.

1. How did you get a Bronco within 4 months of your order? Some people are still waiting for a vin when they ordered 7/13-7/14 2020.

2. Signed purchase order at msrp, should give you leverage with the dealer.

3. You can use this leverage with social media and or actual media and file a report with Ford.

4. The dealer is supposed to sell your Bronco to the person/people who ordered it.

5. However, they the dealer is the legal owner until it is purchased. There is nothing legally to keep them from selling to the highest bidder.

6. Ford has said dealer who break contracts and add adm will lose allocations along with other penalties.

7. If Ford follows through with this or not we don’t know.

Pressure the dealer with thousands of poor reviews if they back out of their contract with you. Then don’t buy anything from them again.

I was surprised to hear I was getting it so soon as well, one thing I did hear was ordering a soft top would shorten the time frame so that's what I went with.
