Dealership Sold my Order

I don’t know if anyone can offer any advice. I reserved a 2022 Ford Bronco in 2020 directly from Ford. It was converted to an order and was built. I was given the VIN number and window sheet directly from ford. The dealership receiving the delivery of my Bronco started refusing the sale after I left a bad review for poor customer service and requested a new salesperson. I was told they would not do business with me and were canceling my order. I contacted Fords corp Customer service 3/18 and was told my bronco will be delivered on or around 3/21/22and that my reservation is still confirmed and was advised by the Ford representative to go to the dealership on this date to claim my bronco and involve the police if The dealership does not let me claim order. I was told by the Ford corp that vehicle was mine and would sold to me and I am protected by my preorder and They are denying me my the property I contracted through Ford. Please let me know if this is something I can get any suggestion on routes to take. I was told on 3/28/2022 the the bronco had been sold.

I would say consult a lawyer and involve the police to possibly sue or press charges

This is going to be considered a civil matter, as opposed to a criminal matter. Think contractual law or something similar. Although I’m not familiar with Utah laws, I am familiar with Virginia laws and I assume they won’t be too different in this situation, and can tell you this does not sound like a typical criminal matter, so police will not be able to help you much with this and will most likely tell you the same thing. If they sold the Bronco, then you will need to talk to a lawyer in your state about what course of action you can take on the civil side of things. Police only deal with criminal matters.

Wow.. lawyer up dude and tell the dealer to do the same. A good lawyer would take this pro-bono as it's an easy win here. You're bound by a contract between your dealer and FMC. This is not the publicity FMC wants, nor your dealer. Bad bad move on their part.

This isn't a police matter. They didn't steal your property. The Bronco wasn't "your" Bronco. You did not contract with Ford. Ford sells to dealerships, dealerships sell to consumers/customers. Your relationship is with the selling dealer, not Ford. The selling dealer sold "the" (not your) Bronco that they purchased from Ford.

BTW, this has been going on for months with dealers and customers.

Here's the problem, technically speaking, you don't own that Bronco, the dealership does, until they sell it to you. Your order sheet if signed by the dealership may or may not constitute a legal agreement that's binding with the dealership. Question, did the dealer take a deposit from you when you converted your reservation to an order? If they did, then you have a much stronger case.

Well, you made a big mistake making a public negative comment on the dealership when you had a vehicle ordered. That's as bad as adding a bunch of credit cards after you get approved for a house mortgage, but before you own the house.

You need to decide now if you want to spend the time and money with a lawyer to get your vehicle. Personally, I can't imagine it would be worth it. Your injury is only the loss of the use of the vehicle, and increased cost for a new order. You might be able to try the public angle. Say you have a local TV news station that has a crew looking for those getting screwed over. You can see if they will take up your case. I'm pretty sure the Dealership wouldn't want more bad press thrown at them on the TV news.

Yes, this approach (bad press, bad reviews, etc.) has been effective in the past with dealerships that tried to add ADM to an order "after the fact". Your big problem is going to be that once the dealer gets their hands on that Bronco if they then immediately sell it to someone else, you're going to be in a tough spot.

If you take them to court the BEST you can hope for is for the court to order the dealer to get you a new Bronco, and, well, we all know how long THAT takes. It's VERY unlikely that the court would take it away from the new owner. A lot depends on your state laws as well. If you have the money to hire a lawyer I would get them into the courthouse and put a temporary restraining order on the dealer to keep them from selling it to someone else until this can be settled.

I’m going to say this again…before taking any legal action…you need to talk to a lawyer in YOUR state that knows civil law about matters like this. You’re going to get a lot of suggestions on an open forum from people in different areas that may not know the law in their own states, let alone your state. If they sold the Bronco and didn’t refund your deposit, you at a minimum have that going for your case, but implied contracts (such as verbal agreements, written agreements, etc.) vary greatly from state to state and you need to talk to an expert before doing things like going to court or even threatening the dealership to do so. I’ve never heard of a restraining order you can put on a dealership to keep them from selling a vehicle that isn’t yours yet…

Not sure how this is going to be winnable. If they've sold your Bronco, then there's no chance of getting it back. If they have to order you another one or purchase one from another dealer, what keeps them from putting a huge ADM on it? It really blows, but not sure there is anything that can be done. Pure slime!

They did not. They told me I needed to get it directly from Ford. Seemed really shady. I’d spoken to Ford Corps today and they said since it was converted to an order that the dealership is responsible. Just seem to be getting the run around right now

The deposits have always lied with the dealership. Corporate never had possession of it.

Yeah, no way that’s legal or correct. The deposits are set up 100% by dealerships, which is why they vary on price.

My point is that you might be able to get a restraining order in order to prevent harm until the matter is settled. You're absolutely right, he needs to talk to a lawyer in his state in order to see what his option are, that's for sure.
